The abuse of process application alleged RCMP used excessive force while arresting the accused in November 2021, and that the group was treated unfairly while in custody. It asked the judge to stay the criminal contempt of court charges or to reduce their sentences based on their treatment by police.

Tammen said it would be inappropriate to stay court proceedings, but found that some of the accused's Section 7 rights— life, liberty, and security of person — were breached during the police raid.

Tammen said these rights were breached when several police officers on two different audio recordings were captured comparing Sleydo' and Sampson to orcs and ogres for wearing red hand prints painted over their mouths — a symbol that represents missing and murdered Indigenous women and girls.

In a separate e-mail to The Globe, Rabinovitch said that “following discussions, Scotiabank and The Giller Foundation agreed that the best path forward was an early end to the partnership.” She did not offer further reasons for the separation. Scotiabank declined to comment on the end of the partnership when contacted by the Globe.

The Giller Prize has been under fire since late 2023, when protesters stormed the stage at its annual gala with signs that read “Scotiabank Funds Genocide.” Scotiabank subsidiary 1832 Asset Management was at that point the biggest international investor in Elbit Systems Ltd., Israel’s most prominent publicly traded arms company.

About 2,000 people, many from the publishing industry, signed a letter in support of the demonstrators. Though the Scotiabank subsidiary has been gradually reducing its stake in Elbit Systems, it still holds a disproportionate amount compared to other Canadian banks, and the Giller Prize spent much of 2024 facing pushback over its ties to the bank.

More than three dozen eligible authors withdrew their latest books for consideration for the 2024 Giller Prize. Alongside eight past nominees and winners, they called on the Giller Foundation in July to cut ties with numerous other organizations “who are directly invested in Israel’s occupation of Palestine.” Prize juror Dinaw Mengestu said that day that he would leave the jury.

Das Berufungsgericht in #Valetta wies heute den Einspruch der #ElHiblu3 gegen die Zuständigkeit #Malta​s für alle 9 Anklagepunkte zurück, und bis zur Hauptverhandlung sollen die Angeklagten in Haft bleiben.

Abdalla, Amara & Kader sind zu Unrecht wegen angebl. terroristischer Aktivitäten, Entführung eines Schiffes, Bedrohung der Crew und weiterer schwerer Straftaten angeklagt.

Free the El Hiblu 3. Standing up for your rights is not a crime.

This morning was the pretrial hearing in Malta of the #ElHiblu3. Sadly, Abdalla, Amara and Kader’s defence plea was dismissed and they continue to face the prospect of many years in prison for protecting their own, and others', human rights.

The three teenagers were amongst 108 people who were rescued by the ship 'El Hiblu 1' in March 2019 following their boat getting into distress in international waters. The cargo ship was then instructed by an EU military aircraft to return them illegally to Libya, clearly documented as an unsafe country for people on the move.

The survivors protested against their return to Libya, convincing the crew to eventually change their course and head to Malta. The teenagers mediated and translated between crew and survivors but on their arrival to Malta were accused, amongst other things, of terrorism, hijacking a ship and threatening crew, when in reality their acts that day ensured no one was harmed and nothing was damaged.

That day they prevented Malta from pushing them back to an unsafe country. Solidarity and the wish for a safe life is not a crime!

David McBride, a whistleblower, has been sentenced to five years and eight months in prison. His case highlights a troubling reality: the first person imprisoned in relation to Australian war crimes in Afghanistan is the one who exposed them, not the perpetrators.

This sends a chilling message to potential whistleblowers nationwide: speak out and risk everything. The impact on democracy is profound, matched only by the toll on McBride and his family. He's not alone – Richard Boyle faces trial later this year. We cannot allow this to continue.

The Federal Government possesses the authority to intervene in these instances, yet has neglected to do so, despite acknowledging the flaws in the laws designed to safeguard whistleblowers.

Join us in demanding a full pardon for McBride, an end to the prosecution of whistleblowers like Boyle, and urgent reform of whistleblower protections.
