Wenn es brenzlig wird, setzt er das Magnet-Blaulicht aufs Dach. <br>Problem: das Targa-Dach ist aus Kunststoff. Daher musste eine Metallplatte untergeklebt werden, damit der Magnet Halt findet. </p><p>Fun-Fact 2: In einem Ludwigshafen-Tatort fuhr der Kommissar einen Fiat 130, eine bei uns relativ unbekannte Luxus-Limousine aus den 70ern. In der Schluss-Verfolgungsjagd wurde der noch recht gut erhaltene Fiat absichtsvoll gecrasht. Die Oldtimer-Szene war entsetzt. <br>Tatsächlich hat sich jemand erbarmt, den Schrott-Fiat gekauft und wieder hergerichtet. Darüber hat dann ein deutsches Oldtimer-Magazin ausführlich berichtet. </p><p>Fun-Fact 3: Die Polizei in Baden-Württemberg hat in den 60ern weiße Porsche 356 (und später 911) angeschafft, angeblich für die Verfolgung von Rowdys auf der Autobahn. Nachdem man feststellen musste, dass die Inspektionskosten bei Porsche horrend hoch waren, wurden die Sportwagen nur noch zur Imagewerbung bei Veranstaltungen ausgestellt. Wer Polizist*in wurde, um endlich mal Porsche zu fahren, wurde also bitter enttäuscht.</p>

Ein paar hilfreiche Fakten: </p><p>- Kriminelles Verhalten ist v.a. bei männlichen Kindern und Jugendlichen sowohl normal („ubiquitär“ = macht jede/r, wenn auch nicht jede/r erwischt wird ;-)), es hört aber in aller Regeln von alleine wieder auf („passageres Phänomen“ = endet auch ohne Maßnahmen von außen). <br>- Schon kurze Zeit im Gefängnis ist für junge Menschen derart schädlich (das bestätigen gerade auch die Leiter*innen von Haftanstalten), dass bei uns alles unternommen wird, um selbst die Vollziehung von kurzer Untersuchungshaft bei Jugendlichen zu vermeiden. Auch Strafhaft wird bis zum Alter von 27 Jahren nach Möglichkeit in gesonderten Jugendhaftanstalten vollstreckt, damit der Einfluss (und die Gewalt) von älteren Gefangenen verhindert wird. <br>- Vor allem aber: Die Frage, ab wann ein Mensch strafbar ist und ob bzw. welche Maßnahmen nach einer Tat möglich sind, haben nichts miteinander zu tun. (Ausnahme: Haft, die gibt es nur nach strafrechtlicher Verurteilung, schadet aber mehr, als sie nützt - siehe oben . Soweit es nur um Sicherung geht, ist geschlossene Unterbringung möglich - siehe unten.)</p><p>Auch nach Absenkung des Strafmündigkeitsalters würde man – zu Recht – alles versuchen, um durch möglichst passende Erziehungsmaßnahmen (die schon heute bis zur geschlossenen Unterbringung reichen können) den jungen Täter zu einem verantwortungsvollen Menschen reifen zu lassen. </p><p>Dazu bräuchte es aber (wie schon heute) nach Meinung praktisch aller Expert*innen noch viel mehr gut ausgebildete Pädagog*innen, Sozialarbeiter*innen, schnelleren Zugang zu psychologischer und psychiatrischer Versorgung für Kinder, Jugendliche und deren Eltern sowie mehr Plätze in geeigneten Einrichtungen, auch mit geschlossenen Abteilungen. An alledem fehlt es in Deutschland massiv. </p><p>Was haben diese Vorschläge miteinander gemein? <br>- Nichts dabei hängt davon ab, ob wegen des Alters formal ein (Jugend-)Strafverfahren stattfinden kann oder dieselben Schritte rein nach Jugendfürsorgerecht ergriffen werden<br>- Nichts davon eignet sich als „man müssten einfach nur…“-Forderung, um schnell und billig den Eindruck von politischer Handlungsstärke zu simulieren. </p><p>Fazit: wer eine Absenkung des Strafmündigkeitsalters fordert, hat entweder das Problem nicht verstanden oder ist nicht an wirksamen Lösungen interessiert.</p><p>Soweit man aus der polizeilichen Kriminalstatistik herauslesen kann, dass mehr Gewalt durch Kinder (meist gegen Altersgenossinnen) verübt wird, muss man hinschauen, ob dies nur darauf beruht, dass mehr Taten angezeigt / festgestellt werden, oder ob auch mehr Gewalt stattfindet. Und dann muss man nach den echten Ursachen einer möglichen Verrohung / Enthemmung schauen. Und im Zivilprozess können die Parteien das Gericht sogar "zwingen", über einen fiktiven Sachverhalt zu entscheiden, indem sei einfach nicht vortragen, was wirklich passiert ist. </p><p>Von daher: kaum etwas ist so relativ, wie die Wahrheit vor Gericht. Wir hatten Euch gewarnt! 🤷‍♀️</p><p>Ab sofort holen wir unsere Video-Podcast-Folgen als reines Audio auf die einschlägigen Podcast-Kanäle. Heute Abend startet es mit dem Prolog. </p><p>Wer also von unserem - objektiv - betörenden Äußeren bislang zu sehr abgelenkt war, hat jetzt keine Ausreden mehr. </p><p>ABER: </p><p>Gut Ding will Weile haben! Daher bitte ein bisschen Geduld: <br>- bis die Folgen von Podigee auf die diversen Plattformen ausgespielt werden, kann es ein bisschen dauern. <br>- wir sind bald bei Folge 10 und der <span class="h-card" translate="no"><a href="https://mastodon.social/@Orkan_der_rechtspflege" class="u-url mention" rel="nofollow noopener noreferrer" target="_blank">@<span>Orkan_der_rechtspflege</span></a></span> arbeitet für mein Gefühl eh schon 48/7, deshalb bitte das Binge-Listening ein bisschen einbremsen. Es kommen mit der Zeit schon alle Folgen und bald sind wir auch sozusagen synchron mit den Videos. </p><p>Und wo geht es dann los?
