Lutra Security<p>Gestern ist mal wieder ein Gericht mit seiner geballten Kompetenz zu einem Urteil gekommen, bei dem man vor Scham im Boden versinken möchte.</p><p>Wer den Fall von Modern Solutions nicht aktiv mitbekommen hat: Modern Solutions schickt(e) ihr Passwort für die Datenbank all ihrer Kunden im Klartext mit ihrer Software mit. Auf die Meldung eines Entwicklers hin, verklagt Modern Solutions diesen.</p><p>Jetzt ist klar: Das Amtsgericht Jülich wertet wohl ein Passwort, selbst wenn es jedem Kunden mit der Software mitgeliefert wird, als besondere Sicherung gegen unberechtigten Zugang und stellt damit die Tat des Entwicklers unter Strafe.</p><p>Statt auf die Expertise eines Sachverständigen zu vertrauen (oder in diesem Fall wohl überhaupt einen zu konsultieren), wird ein Urteil gefällt was so nicht leicht an Absurdität überboten werden kann.</p><p>Die Lösung ist hier aktuell leider nur solange in Revision zu gehen (und dabei Steuergelder zu verprassen) bis man zu einem Gericht vorstößt, das etwas technische Kompetenz zeigt.</p><p>Und ja, viele Gerichte wären hierbei auch heute schon zu einem anderen Urteil gekommen (auch wenn sie sich mit einem völlig unzureichenden "Hackerparagraphen" rumschlagen müssen).
