@robodoll don't call "#AI" Output "#art" because that'll only empower #WIPO and the #CopyrightMafia in their attempts to make it #copyright-able.

  • Which luckily it isn't in #Germany because machines cannot have #authorship and without #author there's neither "creative work" nor "intellectual property" being generated that could be subject to protection!

Still calling it "art" is an insult to any form of art regardless of subjective quality or objective effort.

@resieguen die #GEMAvermutung wird von denen stets geflext, sofern #Kreative sich nicht mit #Klarnamen selbst-doxxen - selbst wenn diese nachweislich keine Mitglieder bei irgendeiner #Verwertungsgesellschafft und bei keinem #Verleger / #Plattenlabel / ... unter Vertrag sind.

Ich stelle mir die Frage was passiert wenn #Musiker*innen, #Komponist*innen u.ä. ihr Zeug explizit so lizensieren dass der #GEMA (und dem Rest der #Copyrightmafia) die #Lizensierung explizit verboten wird!

Auch stelle ich mir die Frage wie das mit nicht-deutschsprachigen / nicht in #Deutschland oder der #EU ansässigen #Musikschaffende|n aussieht.

@snow IMHO #piracy should only be considered "#theft" [with damages being limited to the cost of properly licensing it!] if the pirated material was still offered for licensing new under fair, reasonable and non-discriminatory terms.

In the past, #EA did offer to replace broken discs / cartridges for a nominal fee [AFAIK €10 per disc or €15 for double-discs] if people mailed in the original (broken) media. I'd say that is should apply to everything, tho granted that only allows people in theory to deal with #DiscRot (assuming the publisher is able and willing to perpetually honour this service), not allowing them to legally attain new licenses.

#Valve & #Steam legally workaround this by merely providing access and not a #license per-se.

  • Still, I think #piracy in almost all cases is (as GabeN correctly said:) "A services problem!" and if a product is fairly priced and then people will be willing to pay for it.

I just think that the rampant Enshittification of even #PhysicalMedia is unsustainable and I wish for an #OpenSource #competitor to #BDXL and it's #OnlineDRM!

Piracy will exist as long as #corporate #greed will exist.

If it was my decision #Copyright and #patents would be contingent on the #media / #technology being produced and offered for sale.

  • In fact I think every #claim for #losses should be tossed by any #judge whenever there was no #legal way to obtain a new copy of some content.

Espechally since we live in the #AgeOfAbundance and nowadays the cost for distributing even a #AAA #Game or #Movie is merely the cost of #Storage and #Bandwith, so at worst a whole Euro if we're talking #PayAsYouGo - #Akamai with no minimums to get stuff distributed.

  • We'd be in the single digit cents if we use #P2P technology like #BitTorrent and #IPFS to keep stuff available.

@shaknais @thomholwerda If those assumptions by @senficon were incorrect, then most people I know where lifetime #DebtPeons to the #CopyrightMafia as they learned most stuff not from #Schoolbooks but other media - mostly commercially licensed stuff...
